This privacy policy pertains to the collection, use and disclosure of Personal Information in the custody and control of the Canadian Rheumatology Association (the “CRA”, “we” or “our”).
Personal Information shall include (i) personal information as such term is defined in the Personal Information Protection Electronic Documents Act; information about an identifiable individual except to the extent that the information is about an individual in his or her professional capacity, including his or her name, title, business postal and email address and telephone and fax number. For purposes of this policy, Personal Information shall not include information about CRA employees in such employees’ capacity as employees of the CRA.
It is the policy of the CRA to keep any information gathered through the use of our systems secure. As such, user information is not disclosed or shared to unauthorized third parties except as allowed by Canadian law and described herein.

The CRA has appointed a Designated Privacy Contact who acts as Chief Privacy and Security Officer (CPSO) responsible for information system monitoring and information security policy and procedure management. The CPSO is responsible for compliance with CRA’s privacy program including,

Every user must keep their password and username safe and make sure that any person who has access to view such private information is permitted to do so. The CRA stores all Personal Information in Canada, with Member 365. Personal Information is stored in electronic format on servers that are behind a firewall and physically housed within a secured data center.

The CRA reserves the right to reject, suspend, alter, remove or delete data if it breaches our terms and conditions or it is necessary to protect us or others where we have reasonable grounds for believing that a criminal act has been committed, or if required to do so by law.

Data will be stored according the CRA’s retention schedules in a secure and private manner or deleted as per direction from the user as allowable by operational needs and relevant law. You may request access to your Personal Information and an account of the organizations, if any, to which we have disclosed such information. We will let you know if we are unable to provide you with the Personal Information you have requested within 30 days of your request. We will need to verify your identity before providing you with any Personal Information. We will charge for photocopies made in response to an access request, and will advise you of the cost prior to copying your records.
The CRA may not be able to provide you with access to all of your Personal Information, for example if the information cannot be separated from Personal Information of others, or confidential financial, commercial or other information of the CRA that it does not make public, or information subject to solicitor-client or some other form of legal privilege. If we cannot provide you with access to your Personal Information, we will advise you of the reasons access is being denied, unless we are prohibited by law from doing so.
You may request the correction to your Personal Information by writing to our privacy officer. If we do not believe that it is appropriate to make the correction, we will keep a record of your request with the applicable Personal Information.
Members may also update or otherwise correct Personal Information on or available through their Site profile by accessing their profile.
Security of Personal Information, Use of US Service Providers
The CRA has adopted security measures appropriate to the sensitivity of the information to protect your Personal Information against theft, loss and unauthorized access, use, disclosure, and destruction.
The CRA has appointed a Designated Privacy Contact who acts as Chief Privacy and Security Officer (CPSO) responsible for information system monitoring and information security policy and procedure management. The CPSO is responsible for compliance with CRA’s privacy program including,
Safeguard measures to ensure authorized access include: the use of a username and a password for authentication. Every user must keep their password and username safe and make sure that any person who has access to view such private information is permitted to do so. Users must contact the CRA immediately if the user believes their password has been misused compromised or misused.
The CRA stores all Personal Information in Canada, with Member 365. Personal Information is stored in electronic format on servers that are behind a firewall and physically housed within a secured data center.
However, no data transmission over the Internet can be guaranteed to be 100% secure. As a result, we do not represent, warrant, or guarantee that Personal Information you chose to send us over the Internet will be protected against loss, unauthorized access, misuse, or alterations, and we do not accept any liability for the security of Personal Information while in transit to us, nor for your or third party use or misuse of Personal Information.
Data Retention
The CRA reserves the right to reject, suspend, alter, remove or delete data if it breaches our terms and conditions or it is necessary to protect us or others where we have reasonable grounds for believing that a criminal act has been committed, or if required to do so by law.
The CRA processes and stores the user’s personal information in order to provide the CRA’s services to the user. Data will be stored according the CRA’s retention schedules in a secure and private manner or deleted as per direction from the user as allowable by operational needs and relevant law. The CRA maintains security/privacy policies and procedures to ensure every step is taken to maintain the integrity of the data in our care.
The CRA may use service providers that operate out of the United States and any of your Personal Information that we collect may be processed and stored in the United States. Our Service Providers in the US may be required under US law to disclose Personal Information they are processing and/or storing on our behalf to the United States Government, Government agencies, courts or law enforcement or regulatory agencies in the United States under a lawful order.

Ces fins pourraient inclure, entre autres, le fait de permettre à ces parties de déterminer s’il convient de mettre en œuvre ou de poursuivre la transaction, de satisfaire à toute exigence de rapport ou d’audit à l’égard de ces parties et/ou de divulguer des renseignements personnels dans le cadre de la clôture d’une vente ou d’un transfert d’actifs, nos successeurs et ayants droit pouvant faire de même à des fins quasi identiques à celles énoncées dans la présente politique.
Dans le cas où la transaction n’aboutirait pas, nous exigerons, par contrat, que l’autre ou les autres parties à la transaction n’utilisent ni ne divulguent les renseignements personnels de quelque manière et à quelque fin que ce soit, et qu’elles les retournent ou les détruisent.
La SCR pourrait divulguer des renseignements personnels afin de souscrire ou de maintenir une garantie d’assurance ou de présenter une demande d’indemnisation.
Marketing et collecte de fonds
La collecte que fait la SCR des renseignements personnels, ainsi que leur utilisation et leur divulgation à des fins de marketing et de collecte de fonds, sont entièrement facultatives et ne constituent en aucun cas une condition de votre adhésion à la SCR ou de votre participation à un événement de la SCR. Toutefois, suite au retrait de votre consentement, et vu les calendriers de distribution, il se peut que vous receviez encore des communications à caractère commercial pendant un court laps de temps. La SCR peut vouloir se servir des renseignements personnels que vous lui avez fournis pour vous proposer des produits et services en dehors de ceux que vous avez commandés ou permettre à des tiers désignés de communiquer avec vous au sujet de leurs produits et services qui pourraient vous intéresser. (Remarque : nous ne communiquerons pas directement à un tiers les renseignements personnels vous concernant, sauf accord exprès de votre part).
Dans les cas où la SCR mènerait des études de marché ou de produit, elle ne se servirait jamais de renseignements personnels; au contraire, elle les rendrait totalement anonymes, donc peu susceptibles de permettre l’identification d’un individu.

La SCR se réserve le droit de faire usage des coordonnées des utilisateurs afin de communiquer avec eux sur tout aspect de leur compte ou les services et produits y afférents. Chaque utilisateur pourra choisir de recevoir ou non des communications facultatives (p. ex., presse, marketing, événements), tandis que les communications obligatoires (p. ex., les mises à jour de sécurité, les annonces/révisions de produits) seront acheminées à tous les utilisateurs actifs.
Traitement des renseignements personnels
Seuls les employés autorisés, ayant des motifs professionnels légitimes, ont accès aux informations privées, sensibles et confidentielles, y compris les renseignements personnels des utilisateurs. Tous nos employés sont astreints aux normes de confidentialité de la SCR et doivent s’y conformer, conscients de l’importance que revêt le maintien du caractère privé des renseignements vous concernant. Pour cette raison, nos employés sont tenus de signer une entente de confidentialité qui leur interdit toute divulgation à des tiers non autorisés quelque information que ce soit sur les utilisateurs.
D’autre part, l’accès aux renseignements personnels ou leur divulgation, sans autorisation, leur sont formellement interdits, tous les employés devant en outre veiller, à tout moment, à la confidentialité des renseignements personnels, sachant que tout manquement à cette exigence entraînera des mesures disciplinaires appropriées, y compris le renvoi.
La SCR ne vend ni ne loue jamais les renseignements personnels qu’elle recueille. La SCR ne les divulguera jamais à des tiers, sauf dans les cas prévus dans le cadre de la présente Politique de confidentialité ou si la loi le permet. En outre, la SCR ne divulguera jamais de renseignements personnels à des tiers, sauf si la loi l’exige ou si une autorité légitime en a dûment démontrée la nécessité, ou comme il est prévu dans la présente Politique de confidentialité.
S’agissant de l’hébergement de nos serveurs, la SCR fait appel à des prestataires tiers au Canada et aux États-Unis, lesquels peuvent avoir accès à des renseignements personnels dans le cadre de leur prestation de services à la SCR, l’accès de ces derniers étant toutefois soumis à un contrôle strict, conformément aux mesures de protection décrites ci-dessous.
Au chapitre des divulgations légalement requise, il peut s’agir d’informations relatives à des enquêtes criminelles ou à des exigences de déclaration fiscale. Dans certains cas, tels qu’une procédure judiciaire ou une ordonnance de tribunal, nous pourrions également être tenus de divulguer aux autorités des renseignements personnels vous concernant. Cela dit, seules les informations expressément demandées sont divulguées, et nous prenons des précautions pour garantir que les autorités qui en font la demande ont des motifs légitimes de le faire.

Pour commencer, il est à noter que le Site peut offrir pour la commodité des utilisateurs des liens vers d’autres sites Web de tiers et à l’égard desquels la SCR n’a aucune responsabilité ni assurance quant au fait que ces sites ne font pas partie du Site ou quant à ce qu’il en est de leur collecte, de leur utilisation et de leur divulgation des renseignements personnels des usagers. Collecte et utilisation des informations du navigateur
La SCR recueille de votre navigateur Web, de même que celui de tous les utilisateurs du Site, relativement à son utilisation, des informations (y compris des renseignements non personnels) dont, par exemple, ceux-ci :

La SCR recueille également des informations à l’aide de « témoins », ou des identificateurs alphanumériques anonymes et uniques, que l’ordinateur d’un site Web envoie à votre navigateur, qui sont stockés sur le disque dur de votre ordinateur et qui recueillent par la suite des informations spécifiques à votre ordinateur. Si vous le souhaitez, vous pouvez retirer à tout moment votre consentement à l’utilisation et/ou à la divulgation des renseignements personnels vous concernant, à telle ou telle fin, en avisant notre responsable de la protection de la confidentialité. Toutefois, si vous retirez votre consentement, il se peut que nous ne puissions vous fournir au complet les services auxquels vous avez droit en tant que membre ou, si vous n’êtes pas membre, les produits ou services que vous demandez.
Les conséquences du retrait du consentement vous seront expliquées par la SCR au moment de votre demande dont le délai de traitement est de deux (2) semaines.
Par ailleurs, les membres qui souhaitent annuler leur consentement, par exemple, en refusant les annonces ou alertes et les infolettres, peuvent le faire également en accédant à leur profil au portail des membres de la SCR.
Accès aux renseignements personnels
Vous pouvez demander l’accès aux renseignements personnels vous concernant et à un compte de la société, s’il en est, au sujet duquel nous avons divulgué ces renseignements. Dans le cas où nous ne serions pas en mesure de vous fournir les renseignements personnels demandés, nous vous le ferons savoir dans les 30 jours suivant votre demande. Dans le cas contraire, et avant de vous fournir des renseignements personnels demandés, nous aurons à vérifier votre identité, devrons facturer les photocopies nécessaires en réponse à votre demande d’accès et vous informerons du coût avant de procéder à la reproduction des registres en question.
Il se peut que la SCR ne puisse vous donner accès à tous vos renseignements personnels dans le cas, par exemple, où il est impossible de les séparer des renseignements personnels d’autres parties ou des renseignements financiers, commerciaux, confidentiels ou autres que la SCR ne rend pas publics, ou des renseignements assujettis au secret professionnel ou à une autre forme de privilège juridique. Si nous ne pouvons pas vous donner accès aux renseignements personnels vous concernant, nous vous aviserons des motifs du refus, à moins que la loi ne nous l’interdise.
Vous pouvez demander que des corrections soient apportées aux renseignements personnels vous concernant en écrivant à notre responsable de la confidentialité. Si nous estimons qu’il n’y a pas lieu de procéder à la correction demandée, nous garderons trace de votre demande accompagnée des renseignements personnels en question.
Les membres, en accédant à leur profil, peuvent également actualiser ou autrement corriger les renseignements personnels qui font partie de leur profil sur le Site ou qui sont disponibles par l’intermédiaire de celui-ci.
Sécurité des renseignements personnels, recours à des fournisseurs de services aux États-Unis
Afin de protéger vos renseignements personnels contre le vol, la perte et l’accès, ainsi que l’utilisation, la divulgation et la destruction non autorisées, la SCR a adopté des mesures de sécurité convenant à la sensibilité de ces renseignements.
Parallèlement, la SCR a nommé une personne-ressource qui, en sa qualité de chef de la protection des renseignements personnels et de la sécurité (CPRPS), est responsable de la surveillance des systèmes d’information et de la gestion des politiques et procédures de sécurité de l’information. D’autre part, la CPRSO est responsable de la conformité au programme de protection de la confidentialité de la SCR, lequel consiste notamment à :
Parmi les mesures de contrôle destinées à s’assurer que l’accès est autorisé figurent un nom d’utilisateur et un mot de passe qui doivent être saisis aux fins d’authentification. Chaque utilisateur doit donc garder ses identifiants de connexion (mot de passe et nom d’utilisateur) en sécurité et s’assurer que quiconque a accès à ces éléments d’information privés est dûment autorisé. Tout utilisateur qui estime que son mot de passe a été compromis ou utilisé à mauvais escient doit en informer immédiatement la SCR.
La SCR entrepose tous les renseignements personnels au Canada, auprès de Member 365, le stockage étant fait en format électronique sur des serveurs protégés par un pare-feu et physiquement logés dans un centre de données sécurisé.
Toutefois, aucune transmission de données sur Internet ne peut être garantie comme étant sécurisée à 100 %. De ce fait, nous ne saurions déclarer, garantir ou assurer que les renseignements personnels que vous choisissez de nous acheminer via Internet seront protégés contre la perte, l’accès non autorisé, l’utilisation abusive ou les falsifications. De même, nous déclinons toute responsabilité à l’égard de la sécurité des renseignements personnels pendant leur transit vers nous, à notre destination, ainsi qu’à l’égard de votre utilisation ou du mésusage des renseignements personnels par des tiers.
Conservation des données
La SCR se réserve le droit de rejeter, de suspendre, de modifier, de supprimer ou d’effacer des données si elles portent atteinte à nos conditions générales ou s’il s’avère nécessaire de protéger la société ou d’autres personnes lorsque nous avons des motifs raisonnables de croire qu’un acte criminel a été commis, ou si la loi l’exige.
Pour assurer les services à l’utilisateur, la SCR traite et stocke ses renseignements personnels comme le permettent les besoins opérationnels et la loi pertinente, lesquels sont conservés selon le calendrier de sauvegarde sécurisée et privée de la SCR ou supprimés selon les consignes de l’utilisateur. Dans le souci de préserver l’intégrité des données qui nous sont confiées, la SCR, prenant toutes les mesures voulues, a mis en place des politiques et procédés de sécurité et de protection des renseignements personnels.
De même, la SCR peut faire appel à des fournisseurs de services exerçant leurs activités à partir des États-Unis, auquel cas les renseignements personnels que nous recueillons peuvent être traités et stockés aux États-Unis, ces fournisseurs pouvant être tenus également, en vertu de la loi américaine ou d’une ordonnance légale, de divulguer au gouvernement des États-Unis, à des organismes gouvernementaux, à des tribunaux ou à des organismes d’application de la loi ou de réglementation, les renseignements personnels qu’ils traitent et/ou stockent en notre nom.
